NET10 UNLIMITED RECURRING PAYMENT PLAN TERMS AND CONDITIONS
These terms and conditions govern the NET10 Unlimited Recurring Payment Plan (as defined below) and are in addition to the provisions set forth in the NET10 Terms and Conditions of Service (which can be found at: http://www.net10.com and http://www.net10.com/unlimited).  By enrolling in the NET10 Unlimited Plan, and/or by allowing your credit or debit card information to be used for enrollment in any NET10 Unlimited Plan, you agree and/or reaffirm your agreement to be bound by these terms and conditions and the current NET10 Unlimited Plan Terms and Conditions of Service.

NET10 reserves the right to modify these terms and conditions at any time without prior notice.  The modified terms are binding upon you once posted on our website.  By having subsequent charges for any NET10 Unlimited Plan posted to your credit or debit card, you agree to be bound by any such modifications.  The most current terms and conditions for the NET10 Unlimited Recurring Payment Plan are posted on the NET10 website at:  http://www.NET10.com/unlimited.

1.  NET10 UNLIMITED PLAN DESCRIPTION:  The NET10 Unlimited Plan is a Service offered by NET10 that includes unlimited nationwide local and long distance calling, unlimited nationwide text and picture messaging and unlimited mobile web access.  Data purchased through the NET10 Data Services portal will require separate payment via NET10 Unlimited minute bundles or credit or debit card purchase.  The NET10 Unlimited Plan is not available in all areas and is subject to certain conditions and limitations.  NET10 may modify or cancel the NET10 Unlimited Plan at any time and for any reason without prior notice.  In the event of any modification that increases the charges associated with your NET10 Unlimited Plan, you will receive advance notice prior to being charged the new rate.  The NET10 Unlimited Plan may not be combined with any other discount or promotion.  Additional terms and conditions and certain limitations apply.  See the Terms and Conditions of Service for NET10 Pay As You Go and NET10 Unlimited available on the NET10 website for full details.
2.  ENROLLMENT:  To enroll in the NET10 Unlimited Plan, you must have a NET10 Unlimited phone.  To complete your enrollment, you will need the IMEI/Serial number from your NET10 Unlimited phone, your full contact information (including a valid e-mail address) and a valid credit card (Visa, MasterCard, Discover Card or American Express) or debit card with a Visa or MasterCard imprint.  You can enroll in the NET10 Unlimited Plan from the enrollment page of the NET10 Unlimited website by completing all required information and clicking the "Enroll" box.  You can also enroll by calling Customer Care at 1-877-77NET10 (1-877-776-3810) and providing the required information.  Upon enrollment in the recurring payment plan, your “Next Payment Date” will be 30 Days from the date you enrolled.  Your credit or debit card will be charged automatically on your Next Payment Date. 
3. REPAYMENT AUTHORIZATION:  By enrolling in the NET10 Unlimited Recurring Payment Plan you authorize NET10 to charge your credit or debit card for all fees and costs associated with your NET10 Unlimited Plan, both at the time of enrollment and at subsequent intervals in accordance with the terms of the NET10 Unlimited Plan.  On your Next Payment Date, you will be charged the NET10 Unlimited Plan monthly fee plus applicable sales tax and other federal, state, and government charges such as E911 fees.  You understand and agree that NET10 will continue to post charges to your credit or debit card until you cancel your NET10 Unlimited account.  NET10 will notify you via e-mail to the e-mail address listed on your account each time a charge is posted.  You agree to pay all charges posted by NET10 in accordance with these terms and conditions and the NET10 Unlimited Plan Terms and Conditions.
4. CUSTOMER INFORMATION:  At the time of enrollment, you agree to provide NET10 your current, accurate and complete contact and billing information, including your legal name, address, telephone number(s), e-mail address, applicable payment information (e.g., credit card number and corresponding billing address), as well as any other necessary information NET10 may request for purposes of identification and billing.  You agree to keep your account information current and to notify NET10 immediately in the event of any changes in your contact and/or billing information.  Changes to your account information may be made on the "My Account" page of the NET10 website or by contacting Net10 Unlimited Customer Care at 1-877-77NET10 (1-877-776-3810).  All service communications relating to your plan (enrollment, payment confirmation, etc.) are transmitted to you via e-mail.  Your failure to receive any e-mail communication, regardless of the cause, does not relieve you from any of your obligations under these NET10 Unlimited Plan Terms and Conditions.  For your protection, NET10 will not accept enrollment, cancellation or modification of a NET10 Unlimited Plan via e-mail.
5. CANCELING YOUR NET10 UNLIMITED PLAN SERVICE:  You may cancel your NET10 Unlimited Plan at any time on the NET10 website or by contacting NET10 Customer Care.  NET10 may cancel your NET10 Unlimited Plan and/or terminate your NET10 Unlimited service at any time for any reason, including, without limitation, for non-payment, fraud, abuse of services or unauthorized use of any NET10 service contrary to the terms and conditions of service.  Upon cancellation of your NET10 Unlimited Plan, no additional charges will be posted to your account except for unpaid charges and any fees associated with prior charges.

Once you cancel your NET10 Unlimited Plan, you will no longer have NET10 wireless service.  In order to reactivate your service after cancellation, you will need to re-enroll in the NET10 Unlimited Plan
If you cancel your NET10 Unlimited Service plan, or your NET10 Unlimited Service is otherwise terminated, you will no longer have NET10 Unlimited wireless phone service even if you had service days remaining at the time of cancellation or termination.  NET10 Unlimited plan charges are non-refundable.  Upon cancellation or termination of your service, you will not receive a credit or refund for any unused service days.

6. LOST OR STOLEN NET10 UNLIMITED PHONE:  If your NET10 Unlimited phone is lost or stolen, notify Customer Care at 1-877-77NET10 (1-877-776-3810) immediately to cancel your NET10 Unlimited Plan.  Charges for your NET10 Unlimited Plan will continue to be posted until your NET10 Unlimited Plan is cancelled.
7.  UPGRADES:  You may upgrade your NET10 Unlimited phone while enrolled in the NET10 Unlimited plan at any time and transfer your NET10 Unlimited Plan to the new phone.
8.  ACCOUNT INFORMATION AND PRIVACY:  Upon enrollment in the NET10 Unlimited Recurring Payment Plan, you will be provided with an account password or PIN code.  You agree to protect the security of your account password or PIN code and not provide it to anyone.  If you believe your password or PIN code has been lost or stolen, or someone has gained access to your password or PIN code without your permission, you may change your password or PIN code at any time by logging onto your account at the "My Account" page on the NET10 Unlimited website or by contacting Customer Care at 1-877-77NET10 (1-877-776-3810).  You authorize NET10 to provide information about, and/or make changes to, your account upon the direction of any person able to provide your account password or your PIN code.  See NET10's Privacy Policy posted on the NET10 Unlimited website for more information.
9.  LIMITATION OF LIABILITY:  NET10 is not liable to you, other users of your NET10 Unlimited Plan, or any third party for any failure to post, receive, process or credit a payment on your NET10 Unlimited service or for any other claim or allegation arising out of or in any way related to your NET10 Unlimited Plan, your use of the NET10 Unlimited Recurring Payment Plan and/or your use of our website.
10. CONSTRUCTION WITH NET10 TERMS AND CONDITIONS OF SERVICE:  These recurring payment plan terms and conditions supplement and are in addition to the NET10 Unlimited Terms and Conditions of Service.
